1. Platform License & Access
Subject to your compliance with these Terms, EngiBridge grants you a limited, non-exclusive, non-transferable, and revocable cloud license to access and use the EngiBridge OS Platform strictly for your internal commercial operations.
To maintain the integrity of our enterprise ecosystem, all user accounts must be verified with active, recognized commercial identities (such as official corporate registry numbers). We reserve the right to suspend accounts that fail to provide valid corporate verification upon request.
2. Project & GPV Pricing
EngiBridge OS operates on an enterprise-tier model gated by two primary metrics: the number of Active Projects and the total Gross Project Value (GPV) managed within the system.
You agree that your usage will remain within the limits of your subscribed tier. If your organization exceeds its designated Active Project or GPV limit, EngiBridge reserves the right to automatically upgrade your account to the corresponding tier or restrict further data ingestion until the billing discrepancy is resolved. We will provide a 14-day written notice before applying automatic upgrades.
3. Data Ownership
The Customer retains all intellectual property rights, titles, and interests to their proprietary project data, site logs, financial ledgers, uploaded blueprints, and any other commercial data inputted into the Platform (collectively, "Customer Data").
EngiBridge claims absolutely no ownership over your Customer Data. We process this data exclusively to provide the services outlined in your enterprise agreement and to fuel your isolated instance of the AI Risk Watchtower.
4. Service Level Agreement (SLA)
We understand that construction never stops. EngiBridge strives to maintain a 99.9% uptime for the Platform, calculated on a monthly basis, excluding scheduled maintenance. Scheduled maintenance will always be communicated to your organization's administrators at least 48 hours in advance and will be executed during low-traffic windows.
5. Limitation of Liability
To the maximum extent permitted by applicable law, EngiBridge and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.
Specifically, EngiBridge acts strictly as an operational software provider and shall bear no liability for Liquidated Ascertained Damages (LADs), project delays, or structural failures incurred by the contractor, regardless of whether such delays or failures were associated with the use or unavailability of the Platform.
